Akıt Teorisinin İmâm Ebû Hanîfe Nezdindeki Özellikleri

Abstract

Bu araştırma, İmâm Ebû Hanîfe’nin pek çok yönüyle gerçek kurucusu kabul edildiği akit teorisinin en belirgin özelliklerini bir araya getirmeyi hedeflemekte, akit teorisi hususunda “ilk ve kurucu” olma özelliklerinin ona ait olduğunu ortaya koymayı amaçlamaktadır. Araştırma, akit nazariyesi hususunda diğer mezhep taraftarlarının tamamının ya da önemli bir kısmının muhalefet ettiği ve İmâm Ebû Hanîfe’nin bu konuda kurucu olduğunu ortaya koyan yönlerin ele alınmasına hasredilmiştir. Bununla beraber araştırma, onun akit teorisi ile modern ve beşerî hukuk sistemlerindeki akit teorisinin mukâyesesine de yoğunlaşmıştır.İmâm Ebû Hanîfe’nin akit teorisi hususunda ortaya koymuş olduğu bazı yenilikler şunlardır; ayırt edici bir şekilde akitleri şeklî kısıtlamalardan kurtarma ilkesine dayanması; aynî ve sözlü akitleri birbirinden ayırması; mevkûf akit fikrini ortaya koyması; fâsit akit teorisini te›sis etmesi; akitleri muâvezât ve teberru akitleri olmak üzere ikiye ayırması; özür (akdin mahallinden istifade etmeye engel teşkil eden durumların ortaya çıkması) teorisini ortaya koyması.

This research aims to bring together the most prominent features of the theory of contract, in which Imam Abu Hanifa is accepted as the real founder in many aspects, and aims to reveal that “the first and the founder” characteristics belong to him in terms of contract theory. The study illuminates the pre-eminence and ingenuity of the Imam by focusing on the aspects of the theory in which he was distinguished in developing, differed from the other schools in, and focuses on the legal comparison of the latest legislation and laws in legal contract theory.Among these innovations is his reliance on the principle of liberating contracts from formal restrictions (in a distinctive way), and distinction between Real Contracts and Consensual Contracts. Also includes the idea of the Mortmain contract, and he established the idea of a Deterioration contract, in-addition the division of contracts into Commutative and donations. He also placed the excuse theory in the necessary extended contracts.
