İslam hukuku bağlamında trafik kurallarının değerlendirilmesi

Abstract

Günümüzde ulaşım ve buna bağlı oluşan problemler, vahyin indiği dönemdeki ulaşım biçimi ve karşılaşılan problemlerden farklılık göstermektedir. Nitekim çağımızda kullanılan trafik araçlarının çeşitliliği, yolların niteliği ve trafik yoğunluğu o dönemdeki ulaşım kültürü ve şeklinden çok farklıdır. Dolayısıyla çağımızdaki trafik problemleri ve bu problemlerin doğurduğu sonuçlar da yeni bir konu ve alan olarak karşımıza çıkmaktadır. Trafik ağlarında sürücü hataları, kullanım şekli ve kural ihlalleri sonucunda, insanların beş temel hakkının (can, din, mal, akıl, nesil) bir kısmının ihlal edildiği görülmekte ve bilinmektedir. Bu çalışmamızda İslam hukuku bağlamında çağımız trafik kuralları ve önemi; trafiğin insanların can ve mal kayıplarını nasıl etkilediği, devletin kural koyma yetkisi ve çerçevesi, trafik kurallarına karşı sorumluluklar, kural ihlalleri sonucunda meydana gelen mağduriyetler ve devletin verdiği cezalar incelenmiştir. Bu konular, vahyin indiği dönem göz önünde bulundurularak, yöntem ve tavsiyelerden ve bu kuralların ihlal edilmesi sonucunda meydana gelen can ve mal kaybı ile ilgili hükümlerden yararlanarak araştırılmıştır. O günün ulaşım hukuku ve problemlerinin nasıl ele alındığını ve olayların hangi yöntemlerle değerlendirilip sonuca bağlandığı incelenerek bu yöntemler ışığında günümüz trafiği değerlendirilmiştir.

Today,transportation and the problems steming from this differ from the ones in the reveletion period. For instance,the variety of vehicles used today,the quality of roads and the traffic jam is different from the transportation culture of that period.Therefore,the problems today and the consequences steming from these create a new area and new issues. It is known that,as a result of driver errors in the traffic,the way of usage and the violation of rules some of the five fundamentar rights (life, religion,estate,reason and generation) are violated. In this study,the significance of traffic rules,in what way these rules influence people losing their lives and their estates, the frame of the government for prescription,the responsibilities towards traffic rules,the aggrievements due to the violation of rules and the penalisations of the government have been analysed. These issues have been searched in the context of revelation period ,refering the methods and the advices and the adjudgements of the government about the loss of lives and estates as a result of the violation of these rules.The traffic issue today has been evaluated analysing the way the transportation law and the problems of that period were held and the way the issues were evaluated and brought to the conclusion.
