A Study On Murder and Injury Cases In Ottoman Istanbul

Abstract

In this article, the crimes of murder and injury came across in the archival documents in the Presidential State Archives Presidency Ottoman Archives were examined in terms of causality. The murder and injury cases that occurred in the Istanbul Province between 1912 and 1914 and were selected as samples were discussed using the historical method. In addition, the perspective of Islamic law and Ottoman law on the has been revealed. The late Ottoman penal laws were mentioned and the penalties for the crimes of murder and injury in the 1858 Ceza Kanunnâme-i Hümâyûnu valid during the period we examined were examined. The events in the text are arranged not in chronological order but according to their causes. The ways in which such cases occur, the places where they occur and the offensive weapon used in the cases have been examined. An attempt has been made to determine the factors that cause people to murder and injure others and that drive them to these crimes. Considering how necessary and important the past experiences that knowing the experiences will provide to today's human is, it is thought that making this determination will be useful. The study is important as it pio neers a more comprehensive study of this kind in criminal history research.Bu makalede Cumhurbaşkanlığı Devlet Arşivleri Başkanlığı Osmanlı Arşivi’nde yer alan arşiv vesikaları içerisinde rastlanan adam öldürme ve adam yaralama suçları nedensellik yönünden incelemeye tabi tutulmuştur. Çalışmada 1912 ve 1914 yılları arasında İstanbul vilayetinde yaşanan ve örneklem olarak seçilen adam öldürme ve adam yaralama vakaları tarihsel (historical) yöntem ile ele alınmıştır. Bununla birlikte İslam hukuku ve Osmanlı hukukunun adam öldürme ve yaralama suçlarına bakış açısı sergilenmiştir. Son dönem Osmanlı ceza kanunnamelerine değinilerek incelediğimiz dönemde yürürlükte olan 1858 tarihli Ceza Kanunnâme-i Hümâyûnu muhtevasında yer alan adam öldürme ve yaralama suçlarına verilen cezalar incelenmiştir. Metinde yer alan olaylar kronolojik sıra ile değil de nedenleri doğrultusunda sıralanmıştır. Bu tür vakaların vuku buluş şekilleri, vuku bulduğu mekânlar ile vakalarda kullanılan suç aletleri irdelenmiştir. İnsanların adam öldürme sine ve adam yaralamasına yol açan ve onları bu suçlara sürükleyen etmenlerin tespitine çalışılmıştır. Geçmişte vuku bulan yaşantıları bilmenin günümüz insanlarına kazandıracağı deneyimin ne kadar gerekli ve önemli olduğu nazar-ı dikkate alındığında bu tespitin yapılmasının faydalı olacağı düşünülmektedir. Çalışma suç tarihi araştırmalarında bu türden daha geniş bir çalışmaya ön ayak olması bakımından önem arz etmektedir.
