Kâsânî'nin "Bedâi?u's-Sanâi?" adlı eserinde İmam Sâfiî'ye ait görüşlerin tahkiki (İbadât bölümü)"

Abstract

Hicri 587 yılında vefat eden Kâsânî Hanefî mezhebinin önemli âlimlerinden birisidir. Bu âlimin en önemli eseri Bedâi?u's-Sanâi?'dir. Kâsânî bu eserinde Ebu Hanife, İmam Muhammed, Ebu Yusuf ve bazen de İmam Züfer'in görüşlerinin yanında diğer mezhep imamlarının görüşlerine de yer vermektedir. İmam Şâfiî'nin mezhebi de bunlardan bir tanesidir. Bu çalışmamızda Kâsânî'nin Bedâi adlı eserinde ibadetler bölümünde İmam Şâfiî ve Şâfiî mezhebine nispet ettiği görüşlerini Şâfiî mezhebi kaynaklarından tespit ve tahkik etmeye çalıştık. Bu çalışmamız beş bölümden oluşmaktadır. Birinci bölümde temizlik kapsamında değerlendirilen abdest, suların kısımları, mestler üzerine mesh, gusül, istincâ, teyemmüm ve kadınların özel halleri olan âdet ve lohusalık konuları, ikinci bölümde namaz ve cenaze, üçüncü bölümde zekât ve oruç, dördüncü bölümde hac ve umre, beşinci bölümde literatürde ibadet kapsamında değerlendirilen itikâf, yeminler, yiyecekler, hayvan kesimi ve avlanma, kurban, adaklar, keffâretler, içecekler ile helaller ve haramlar konuları ele alınmıştır. İmam Şâfiî'ye veya Şâfiî mezhebine nispet edilen konular hakkındaki görüşler Şâfiî fıkıh kitaplarına müracaat edilerek tespit edilmeye çalışılmıştır. Nispetinde isabet edildiği yerde râcih (yani müftâ bih) olan görüşün nakledildiği, isabet edilmediği yerde eğer nakledilen görüş mezhepte zayıf ise görüşün zayıf olduğu, nakledilen görüşün nispeti hatalı ise görüşün hatalı olduğu belirtilmiştir. Sonuç olarak Kâsânî bu eserinin ibadetler bölümünde İmam Şâfiî'ye veya Şâfiî mezhebine 512 görüş atfetmiş olup bunlardan 451 tanesinde râcih görüşü nakletmiş, 37 tanesinde zayıf görüşü nakletmiş, 24 tanesinde de hata etmiştir.

Kâsânî, who died in 587, is one of the most important scholars of the Hanafi sect. The most important work of this scholar is "Bedâi?u's-Sanâi?.'' In his work, Kâsânî also included the views of Abu Hanifa, Imam Muhammad, Imam Abu Yusuf and sometimes Imam Züfer, as well as other sectarian imams. One of these is the sect of Imam Shafi'i. In this study, we tried to determine and confirm the views of Shafi'i sect from the Kâsânî's Bedâi?u's-Sanâi?, in the section of worship, in relation to Imam Shafi'i and Shafi'i sect. This study consists of five parts. In the first chapter, ablution, the parts of the waters, the meshes on the mests, full ablution, istincâ, dry ablution and the special cases of women like menstruation and confinement. In the second chapter, prayer and funeral issues. In the third chapter, the subject of zakat and fasting. In the fourth chapter, hajj and umrah subjects. In the fifth chapter, itikâf, which we call other worshipes and evaluated in the context of worship in the literature, oath, foods, hunting, sacrifice, vow, atonement, beverages and work (helals and haram) are discussed. The views on the subject of Imam Shafi'i and Shafi'i sect were tried to be determined by applying to the Shafi'i fiqh books. Where it is a hitting mark, the view of râcih ( muftâ bih) is conveyed; where it is not a hitting mark, if the sighted view is weak in the sect, it is stated that the opinion is weak and if the opinion is incorrect, the opinion is incorrect. As a result, in the worship section of this work, Kâsânî has attributed 512 views to Imam Shafi'i and Shafi'i sect. In 451 of them, he conveyed the opinion of râcih. In 37 of them, he conveyed weak views. In 24 of them, he made a mistake.
