İslam fıkhında vakıfla ilgili kaide ve zabıtlar

Abstract

Bu araştırmada fıkhın önemli konularından biri olan Vakıfla ilgili fıkıh kaideleri ele alınmış ve bunların tesbitinde tümevarım metoduna dayanılmıştır. Bu çerçevede fıkıh ve vakfın sözlük ve terim anlamlarının beyanı dahil birçok hususa işaret edilmiş daha sonra bu konuyla bağlantılı kaideler vakfın rükünlerine göre taksim edilmiştir. Birinci kısımda vakfedenle ilgili iki kaide zikredilmiştir. İkinci kısımda ise vakfedilen malla ilgili dört kaide işlenmiştir. Üçüncü kısımda ise mavkufu aleyhi yani kendisine vakıfedilen şahısla ilgili dört kaide ele alınmıştır. Dördücü kısımda ise vakfedenle ilgili bir kaide incelenmiştir. Ayrıca bu bölümlerin her birinde kaidenin dayandığı delil zikredilmiştir. Daha sonra her kaidenin altına giren uygulamalardan bahsedilerek konu detaylı bir şekilde ele alınmıştır.

In research, I have discussed doctrinal rules in an important section of Islamic doctrine sections. That department is the Islamic endowment. In essay, I have depended on the comparative inductive appraoch and I have highlighted so much things like for instance; Clarifying both language and idiomatically the meaning of doctrine and endowment . Then, I have mentioned the rules that are connected with that section and by depending on the endowment parts, I have divided into three departments; In the first section, I have mentioned endowment formula rules and there are two rules. In the second section, I have mentioned the rules that are connected with the subject of endowment and there are four rules. In the third section, the money that is a subject of endowmen and there are four rules . In the fourth section I have mentioned endowment rules and there is a one rule . Finally, I have referenced in each section of these sections the rule proof that I have depended on then, I have explained in details by recalling what includs under it from applications.
