Namusu/nu kanla temizleyenler: Mardin cezaevi’nde namus davası nedeniyle yatan mahkûmlar üzerine bir araştırma

Abstract

Toplum, toplumsal normlar ve değerler etrafında ete-kemiğe bürünen farklı unsurların bir araya gelerek oluşturmuş oldukları ahenkli bir bütündür. Bu yapı içerinde asalet ve şeref gibi kavramlarla da bağlantılandırılan “namus” olgusuna ters düşen davranışlara karşı öldürme de dâhil değişik yaptırımlar geliştirilmiştir. Bu çalışmada Mardin Cezaevinde namus davası nedeniyle hüküm giymiş mahkûmlarla yarı yapılandırılmış mülakat tekniği vasıtasıyla yapılan görüşmeler sonucu elde edilen verilerden hareketle; mahkûmlar tarafından namusun nasıl algılandığı, aileden veya çevreden herhangi bir baskı görüp görmedikleri, işlemiş oldukları suçtan dolayı pişman olup olmadıkları, hukukun bu tür olayları önlemede ne derece caydırıcı olduğu ve namuslarını niçin kanla temizleme yolunu tercih ettikleri üzerinde durulacaktır.

Society is a harmonious whole that different elements which come to existence around the social norms and values have built by coming together. Inside this structure various sanctions including killing have been developed for the crimes committed against ‘honour’ conception that includes values such as nobility, dignity and esteem. In this study, why they have opted to restore their honour with blood will be analysed with the guidance of the data obtained via the semi-structured interview method applied to the prisoners convicted of honour issue in Mardin jailhouse and with the assistance of questions such as how the honour is perceived by the prisoners, whether their family or the neighbourhood put them under pressure, if they regret the crime they have committed and how much the law is deterrent in preventing this kind of events.
