Abstract
Bu çalışmada, İslâm hukukunda önemli bir yer işgal eden vakıf konusu, ayrıntılı bir şekilde ele alınmıştır. Konu, İslâm hukuku mezhepleri arasında karşılaştırmalı olarak, tarafların delillerinin zikredilmesi ve yer yer tercihe gidilmesi suretiyle açığa kavuşturulmaya çalışılmıştır. Çalışmamızın amacı, İslâm dininin büyük önem atfettiği vakıf konusunun, geçmişten günümüze ortaya çıkışını, toplumsal etkilerini, mahiyetini ve hükümlerini, özellikle fıkhî boyutunu, İslâm âlimlerinin görüşleri ekseninde açıklamaktır. Vakıf müessesesinin ele alındığı bu çalışmamız, üç bölümden oluşmaktadır. Birinci bölümde, vakfın kavramsal çerçevesi başlığı altında vakfın sözlükve terim anlamlarına değinilmiş, mezhep âlimlerinin tanımlarına yer verilmiştir. İkinci bölümünde ise, vakfın genel çerçevesi ele alınmış, bu kapsamda vakfın türleri ve konusu, genel hükümleri ve vakfın tamamlanması için gereken şartlar ele alınmıştır. Son bölümde ise vakfın rükünleri olan; vakfeden, mevkûf, mevkûfu aleyh ve sıyga konuları işlenip bunlarla ilgili şartlarincelenmiştir. Böylece bu çalışmada, vakıf müessesinin fıkhi boyutunu,mezhep âlimlerinin görüşleri doğrultusunda, detaylı bir şekilde incelemeye çalıştık.
In this study waqf, an important part of Islamic Law, is studied in details. The issue is tried to be clarified by comparing, contrasting between the madhabs of Islamic law and by mentioning the reasons of each party and at times by opting for one of them. The aim of our study is to explain the emergence of waqf, which has been attributed great importance by Islam, its sociological effects, its nature, rulings and especially its Islamic juridical dimensions. This study that deals with the concept of wafq consists of three parts. In the first part under the heading of the conceptual framework of waqf, its lexical meaning and its meaning as a term are dealt with and the definitions made by the scholars of each madhab are included. In the second part of this thesis the main framework of waqf is dealt with and under this framework the subject of waqf and its sorts, its general rulings and the conditions necessary for the fulfilment of waqf are dealt with. In the last part, the elements of waqf- the donator, mawquf, mawquf aleyh, sıgya- are dealt with and related conditions are explained. So, in our study we tried to explain the Islamic juridical dimensions of the concept of wafq in details and in accordance with the opinions of madhab scholars.
