Abstract

Araştırma, fıkıh meselelerde ihtilaftan çıkış ilkesinin öneminden, gerçekleşmesinin şartlarından, denetimlerinden ve dayanaklarından bahsederek ihtilaftan çıkış kuralı konusunu ele almaktadır. Fıkıhçıların arasında bu ilkeyi benimsemelerinde farklılık olmuştur ve Maliki mezhebi en çok bu kuralı benimsemiş ve doktrinlerinde dayandıkları ilkelerden biri haline gelmiş ve bununla ün kazanmıştır. Bu araştırma, fıkıhçıların ihtilaftan çıkma konusunda koydukları kuralları belirtmiş olup kendi görüşlerinden çıkıp diğer mezheplerin görüşüne tabii olmanın şartlarını ve usullerini ele almıştır. Araştırmada ayrıca bu kuralın fıkhî meselelere etkisine, özellikle Hanefi mezhebinin ibadet bölümünde, fıkıh mezhebinin fakihlerinin görüş ve sözlerine dayanarak, onların tartıştıkları hususlara değinilerek yer verilmiştir. İhtilafı fıkıh kitaplarının tasnifine göre tasnif edilmiştir. Ardından araştırmanın en önemli bulgularından ve bu konunun daha geniş ve kapsamlı bir şekilde incelenmesine katkı sağlayabilecek önerilerden bahsederek araştırmayı sonlandırdım.

This research deals with the rule of stopping controversy by talking about the importance of this rule in the doctrinal applications, the conditions for its verification, its principles and its pillars. The jurists vary in their adoption of this principle between expanded and narrow, and the Maliki school of thought took this rule the most, but it became one of the assets that they relied on in their doctrine and they became famous and relied on it in the reasoning of the rulings and the graduation of the branches, and hardly a book on the branches or the origins is devoid of mentioning this rule. This research came to address this principle and to indicate the foundations on which the jurists relied and the rules through which they controlled the adoption of this principle in reversing the statement of their doctrine to the doctrine of their opponents. The research also included the impact of this rule on jurisprudential issues, especially in the section of worship in the Hanafi school of thought, based on extrapolating the opinions and sayings of the jurists of the school of thought, and mentioning the issues in which they argued to leave the dispute classified according to the classification of jurisprudence books. Then I ended the research by mentioning the most important findings of the research and the proposals that may contribute to the study of this subject in an expanded and more comprehensive manner.
