Fitne ortamında ahkamın değişimi

Abstract

İslam Hukukundaki kimi hükümler, şartların değişimine bağlı olarak değişikliğe uğramaktadır. İkrah ve ıztırar halindeki kimi hüküm değişiklikleri bunun örnekleridir. Bu çalışmada fitne şartlarının yaşandığı ortamda hükümlerin değişip değişmediği incelenmiştir. Hadis-i şeriflerde fitne ortamındaki kimi hüküm değişikliklerinden bahsedilmiş. Dahası hüküm değişikliğinin yaşanması gereken fitne ortamının özellikleri de anlatılmıştır. Çalışmada bu özellikler belirlenip tasnif edilmiştir. Fitne ortamının en önemli özellikleri şunlardır: Bu ortamda cehaletin yaygınlaşıp sağlıklı düşünme ortamının bulunmaması sebebiyle hak batıldan tam olarak tefrik edilememektedir. Diğer taraftan bu ortamda tüm Müslümanları temsil eden bir halife bulunmaz iken her biri kendi başına saf hakikati temsil etmeyen çok sayıda grup mevcuttur ve bunlar çatışma ve çekişme halindedirler. Yanı sıra bu ortamda hem yaygın bir ahlaki yozlaşma hem de güvenin kalmaması sebebiyle tam bir toplumsal çöküntü hali yaşanmaktadır. Tüm bu olumsuzlukları gidermek gerekmekte ancak bunu düzeltmek için kendileri ile sorumluluk altına girilebilecek insanların nerede ise yokluğu sebebiyle bir gayret de gösterilememektedir. İşte böyle bir ortamda nasların işareti ile bazı hükümlerin değişikliğe uğradığı görülmektedir. Bunları şu şekilde saymak mümkündür: İmam/halife tayin etme ve ona biat etme yükümlülüğü düşmektedir. İyiliği emir ve kötülüğü engelleme görevi sadece güvenilen insanlara hakkı ve sabrı tavsiye şeklinde daha hafif bir forma bürünmektedir. Bu ortamda meşru müdafaada bulunmak ve silah bulundurmak caiz olmamaktadır. Yine kendini bütünüyle ibadete vermek, uzlete çekilmek ve mal/evlat yönüyle hafiflik bu ortamda teşvik edilirken hakkı açıkça söylemek ve hakkını talep etmek çeşitli şartlara bağlanmaktadır.

Some adjudications in the Islamic Law are subject to change depending on changes in the conditions. I have mentioned examples of this situation in my work. I have also tried to examine whether the adjudications were changed in the environment where the conditions of dissension (fitnah) are experienced, and subsequently I have determined that some adjudications had changed. In the hadiths, the characteristics of the dissension (fitnah) environment in which a change of adjudications should be experienced were explained. I have spotted and classified these characteristics from the hadiths. The most important features of the environment of dissension (fitnah) are as follows: In this environment, due to ignorance become a widespread phenomenon and the environment for healthy thinking disappears, the right cannot be completely differentiated from the wrong. On the other hand, because of not having an imam/caliph who represents all Muslims in this environment, many groups which have conflicts and contentions among themselves and none of them represents the pure truth emerge. In addition, in this environment, there is a state of complete social collapse due to both widespread moral degeneration and lack of trust. It is necessary to eliminate all these negativities, but usually an effort is not been made due to the lack of people who can be trusted or who can take responsibility to correct the situation. In such an environment, I found out that the following adjudications were changed with the sign of the hadiths: The obligation of appointing an Imam/Caliph and paying allegiance to him is being removed. The duty of commanding good and preventing evil takes a lighter form as "to advise the truth and patience only to trusted people". In this environment, it is not permissible to defend yourself and to possess a gun. Giving oneself to worship completely and being reclusive in terms of property/children are encouraged in this environment, while expressing the right and demanding the right become subject to various conditions.
