Diyarbekir'deki Zimmîlerin hukuki, sosyal ve iktisadi durumu (1650-1725)

Abstract

Bu çalışmada1650-1725 yılları arasında Diyarbekir'de yaşayan Zimmîlerin hukuki, toplumsal ve ticari ilişkileri ile gündelik yaşamları şer'iyye sicillerinden, seyahatnamelerden ve diğer yardımcı kaynaklardan yararlanılarak resmedilmiştir. Diyarbekir Zimmîleri bağlamında, genel olarak Osmanlı Devleti'nde Zimmîlerin devlete karşı olan hak ve yükümlülükleri, millet sistemi içerisinde Zimmîlerin nasıl yönetildiği, Zimmî grupların din ve mezhep bakımından ve etnik açıdan nasıl tasnif edildiği incelenmiştir. Hukuksal anlamda incelemeye alınan Diyarbekir Zimmîlerinin, şer'i mahkemelerde nasıl tarif edildiği, bu mahkemelerden Zimmîlerin nasıl yararlandığı araştırmaya konu edinilen başka bir husustur.Şer'i mahkemelerdeki MüslümanlarlaZimmîlerin kendi aralarındaki davalarda mahkemelerin oldukça titiz davrandığı ve delillerin ön planda tutulduğu görülmektedir.Sosyal açıdanDiyarbekir'de Müslümanlarla Zimmîlerin münasebetlerinin iç içe geçtiği, ihtidaların yaşandığı, bölgedeMüslümanlarla Zimmîlerindışında başka toplulukların da varlığını sürdürdüğü belirtilmelidir. Buradaki Zimmî nüfusunun ne kadar olduğuyla ilgili bir tespitte bulunmak zor olsa da elimizdeki mahkeme defterlerinden yola çıkarak Diyarbekir'de o dönemde hatırı sayılır bir Zimmî nüfusun var olduğu düşünülmektedir. Ticarette de söz sahibi olmayı başaran Zimmîlerin şehirde icra edilen mesleklerin, iş kollarının çoğunda ön planda olduğu tespit edilmiştir.Cizye konusunda Zimmî din adamlarının diğer Zimmî halka göre ayrıcalıklı olduğu ve bu vergiden muaf tutuldukları görülmektedir.

In this study, the legal, social, commercial relations and daily lives of the Zimmîs living in Diyarbekir between 1650-1725 is depicted using the sherry registers, travelogues, and other ancillary sources. In the context of the Diyarbekir Zimmîs, in general, the rights and obligations of the Zimmis living in the Ottoman Empire and how the Zimmis have been governed in the nation's system and Zimmîs groups in terms of religion and sect and ethnicity are examined. It is another matter which explains how Diyarbekir Zimmis was examined in the intendment of law, how it was described in the courts and how the Zimmîs benefit from these courts. It is observed that,The lawsuits between the Muslims and the Zimmîs in the courts,the courts are very carefully treated and the evidence is being kept in preliminary courts. In social terms, in Diyarbekir it is important to note that there are other societies, including the Muslims and the Zimmîs, in the region, where the impediments of the Muslims and Zimmîs are intertwined. Although it is hard to find out how difficult the Zimmî population here is, it is thought that there is a considerable number of Zimmîpopulation in Diyarbekir, starting from the courtesy of our court. Zimmis, who succeeded in being a prominent business, have been found to be in the forefront in most of the professions performed in the city. It is also seen that Zimmî clerics are privileged to belong to other Zimmî people, and they are exempted from this tax regarding to cizye.
