Abstract
Çağdaş siyaset felsefesinde Anarşi, Devlet ve Ütopya adlı eseriyle dikkat çeken Robert Nozick, bu eserinde yer alan Minimal Devlet Felsefesi ve bu çalışmada Minimal Devlet Felsefesi bağlamında birey-devlet İlişkisi incelenmeye çalışılmıştır. Nozick'e göre haklar pozitif değil, negatiftir. Ve ancak bu haklar üzerine kurulan bir devlet meşrudur. Bu devlet Nozick'e göre minimal ya da gece bekçisi devletidir. Nozick'in temel tezlerinden birisi; doğal hakları ahlaki temel olarak alan bir perspektiften hareketle, minimal bir devletten daha büyük bir devletin ahlaken meşrulaştırılamayacağına yöneliktir. Nozick'in diğer bir tezi de, minimal devletin belirli koşullar altında ahlaken meşru olduğuna ilişkindir. Nozick tarafından ortaya konulan düşünceler doğrultusunda, siyaset felsefesinde birey-devlet ilişkisi ve bu ilişkide hak ve özgürlüklerin ne şekilde dağıtıldığıyla ilgili birtakım değerlendirmelerde bulunacağız.
Robert Nozick, who draws attention with his work Anarchy, State and Utopia, try to examine Minimal State Philosophy in this work and individual-state relationship in the context of Minimal State Philosophy. According to Nozick, rights are negative, they are not positive. And however, the state that builds upon these rights is legal. According to Nozick, this state is minimal or night watchman. One of the main theses of Nozick; from a perspective that takes natural rights as a moral basis, it is aimed that a state bigger than a minimal state cannot be morally legitimated. Nozick's other main thesis is that the minimal state is morally legitimated under certain conditions. In line with the ideas produced by Nozick, we will make some evaluations about the relationship between the individual and the state in political philosophy and how the rights and independence are distributed in this relationship.
