577 (3774) numaralı Diyarbekir şer'iyye sicili (Değerlendirme ve transkripsiyon)

Abstract

Şer'iyye sicilleri, Osmanlı tarihinin aydınlatılması açısından birincil kaynaklardır. Bilhassa, sosyo-ekonomik, sosyo-kültürel, dinî ve siyasî birçok konunun aydınlatılması amacıyla bu defterlerin önemi her geçen gün artmaktadır. Çalışmamıza mesned teşkil eden 577 Numaralı Diyarbakır Şer'iyye Sicili defteri XIX. asrın son çeyreğindeki mahkeme kayıtlarını ihtivâ etmektedir. 577 numaralı defter 16 varak ve 68 hükümden oluşmaktadır. Defterdeki en erken tarihli hüküm 1135 (1723) tarihlidir. En son ise, 1269 (1853) tarihli hüküm yer almaktadır. Defterdeki hükümler çoğunlukla verâsetle ilgili olmasına rağmen, evlilik, boşanma, yol tamiri ve başka şehirlere göçler, yaralama ve gasp suçlarına ilişkin mehkeme kararları da yer almaktadır. Bu kararlar, dönemin sosyo-ekonomik ve sosyo-kültürel yaşamına ışık tutmaktadır.

Şer'iyye registers are the primary sources in terms of illuminating the Ottoman history. In particular, the importance of these notebooks is increasing day by day in order to illuminate many socio-economic, socio-cultural, religious and political issues. Diyarbakır Şer'iyye Registry No. 577 which constitutes the basis of our study, was published in the XIX. It contains the court records of the last quarter of the century. Şer'iyye Registry have 16 leaves and 68 court order. The earliest date of the court order is dated 1135 (1723). The last court order is dated 1269 (1853). Although the court orders that in the Şer'iyye Registry, are mostly about inheritance, there are also court decisions regarding the crimes of marriage, divorce, road repair and migration to other cities, injury and extortion. These court orders shed light on the socio-economic and socio-cultural life of the period.
